These Terms of Service (“Terms”) govern your access to and use of TheGolfGuys.com, including any purchases, content, features, products, services, emails, text messages, and other online services offered by The Golf Guys, TheGolfGuys.com, or our related business operations, including our retail store located at 3440 Renaissance Blvd Unit 8, Bonita Springs, FL 34134 (“The Golf Guys,” “we,” “our,” or “us”).

By accessing our website, creating an account, placing an order, contacting us, or otherwise using our services, you agree to be bound by these Terms, our Privacy Policy, our Return Policy, our Shipping Policy, and any other policies posted on our website. If you do not agree, you should not use our website or purchase from us.


1. Eligibility and Use of Website

You must be at least 18 years old, or the age of majority in your state or jurisdiction, to make a purchase from our website. By using our website, you represent that you have the legal authority to enter into these Terms.

You agree not to use our website or services for any unlawful, fraudulent, abusive, harmful, or unauthorized purpose. You may not interfere with the security or operation of the website, attempt to access systems or data without permission, scrape or copy content without authorization, submit false information, misuse promotional codes, or engage in conduct that harms The Golf Guys, our customers, our vendors, or any third party.

We reserve the right to refuse service, suspend or terminate accounts, cancel orders, restrict website access, or take other appropriate action if we believe a user has violated these Terms, abused our policies, engaged in suspicious activity, or created risk for our business, customers, vendors, payment processors, or shipping partners.


2. Product Information and Availability

We make reasonable efforts to display accurate product descriptions, specifications, images, pricing, availability, condition notes, and related information. However, we do not guarantee that all product information is complete, accurate, current, or error-free.

Product images may differ from the actual item due to lighting, screen settings, manufacturer updates, packaging changes, stock imagery, or variations in product condition. Specifications such as shaft, loft, flex, length, lie, grip, handedness, club condition, headcover inclusion, wrench inclusion, and accessory inclusion should be reviewed carefully before purchase.

Inventory availability is not guaranteed until your order is accepted and fulfilled. Products may become unavailable, discontinued, miscounted, damaged, or otherwise unable to ship. We reserve the right to limit quantities, discontinue products, update product information, or cancel any order if inventory is unavailable or inaccurate.


3. New, Used, Pre-Owned, Demo, and Open-Box Products

The Golf Guys may sell new, used, pre-owned, demo, open-box, closeout, refurbished, or otherwise non-new golf equipment and accessories.

Unless expressly stated otherwise on the product page, used, pre-owned, demo, open-box, and similar items may show cosmetic wear, including marks, scratches, bag chatter, sole wear, face wear, grip wear, shaft wear, missing accessories, aftermarket components, or other signs of use. Such cosmetic condition does not necessarily affect playability.

Condition ratings, photos, and descriptions are provided as a good-faith summary and are not a guarantee that every cosmetic or functional detail has been identified. Customers are responsible for reviewing all available product information before purchase.


4. Orders, Acceptance, and Cancellation

Placing an order does not guarantee acceptance of that order. Your order is an offer to purchase the selected product or products. We reserve the right to accept, decline, cancel, refund, or limit any order for any reason, including but not limited to inventory errors, pricing errors, product listing errors, payment issues, suspected fraud, shipping restrictions, high-risk transactions, resale concerns, or violation of these Terms.

An order is not accepted until we confirm acceptance, process payment, and/or ship the product. Automated order confirmations do not constitute final acceptance of an order.

We may contact you to verify information before processing or shipping an order. If we are unable to verify necessary information, we may cancel the order and issue a refund to the original payment method.


5. Pricing, Errors, and Promotions

Prices, discounts, promotions, product availability, and offers are subject to change without notice. We reserve the right to correct errors, inaccuracies, omissions, or mispriced items at any time, including after an order has been submitted.

If an item is listed at an incorrect price or with incorrect information, we may cancel the order and refund any amount paid, even if the order was confirmed. We are not required to honor pricing or listing errors.

Promotional codes, discounts, coupons, gift cards, store credits, and special offers may be subject to additional terms, expiration dates, exclusions, product restrictions, quantity limits, or other conditions. Promotions may not be combined unless expressly stated. We reserve the right to modify, suspend, or cancel promotions at any time.


6. Payments, Billing, and Fraud Prevention

You agree to provide current, complete, and accurate billing, shipping, and payment information. By submitting payment information, you represent that you are authorized to use the selected payment method.

We may use third-party payment processors, fraud-prevention services, address verification tools, identity verification tools, or other security measures to help process orders and reduce fraud. We reserve the right to decline, cancel, or delay any order that appears suspicious, fraudulent, unauthorized, or high risk.

You agree not to initiate improper chargebacks or payment disputes. If you believe there is an issue with your order, you agree to contact us first so we can attempt to resolve the issue. We reserve the right to contest chargebacks, recover costs, restrict future purchases, or take appropriate action where we believe a chargeback is improper or fraudulent.


7. Shipping, Delivery, and Risk of Loss

Shipping options, costs, estimated delivery windows, and available carriers may be displayed during checkout or on our Shipping Policy page. Delivery estimates are not guarantees. Shipping delays may occur due to carrier delays, weather, holidays, incorrect addresses, high order volume, inventory issues, customs delays, or events outside our control.

We will make reasonable efforts to ship orders within the timeframe stated at checkout or on the applicable product page. If no specific shipping timeframe is provided, we will make reasonable efforts to ship within a commercially reasonable time.

Title and risk of loss pass to you when the product is delivered to the shipping carrier, except where applicable law provides otherwise. We are not responsible for packages lost, stolen, delayed, misdelivered, or damaged after being transferred to the carrier, but we may assist with carrier claims where appropriate.

You are responsible for providing a complete and accurate shipping address. We are not responsible for delays, losses, additional fees, or failed deliveries caused by incorrect, incomplete, or undeliverable addresses.

Certain products may be subject to shipping restrictions, carrier limitations, oversized shipping charges, signature requirements, or geographic restrictions. We reserve the right to cancel orders that cannot be shipped lawfully, safely, or economically.


8. Returns, Refunds, and Exchanges

Returns, refunds, exchanges, cancellations, restocking fees, return windows, product-condition requirements, and excluded items are governed by our Return Policy, which is incorporated into these Terms by reference.

Unless required by law or expressly stated in our Return Policy, shipping charges, return shipping costs, handling fees, special-order fees, custom-order fees, and other service fees may be non-refundable.

Products must be returned in accordance with our Return Policy. Items returned used, damaged, altered, missing components, missing packaging, or outside the eligible return window may be rejected or subject to a reduced refund.

9. Custom Orders, Special Orders, Fittings, and Modified Products

Custom orders, special orders, personalized items, built-to-order clubs, altered clubs, reshafted clubs, regripped clubs, adjusted clubs, shortened or lengthened clubs, custom-stamped items, and other modified products may be final sale unless otherwise stated in writing.

You are responsible for confirming all custom specifications before placing an order, including but not limited to shaft, flex, length, loft, lie, grip, grip size, handedness, swing weight, tipping, adapter, finish, personalization, and other build details.

We are not responsible for customer-submitted specification errors. Manufacturer tolerances, component availability, lead times, and build variations may apply.


10. Manufacturer Warranties

Many products sold by The Golf Guys may be covered by a manufacturer’s warranty. Manufacturer warranties, if available, are provided by the manufacturer, not by The Golf Guys.

Warranty coverage, warranty duration, exclusions, repair options, replacement options, and claim procedures are determined by the manufacturer. We do not guarantee that any product will be eligible for warranty coverage. Used, pre-owned, demo, open-box, closeout, altered, or modified products may have limited or no manufacturer warranty.

To the fullest extent permitted by law, The Golf Guys disclaims all warranties not expressly provided by us in writing, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.


11. Product Use and Assumption of Risk

Golf equipment, training aids, accessories, apparel, footwear, tools, and related products should be used only as intended and in accordance with any manufacturer instructions, safety warnings, fitting recommendations, and applicable rules.

You are responsible for selecting products appropriate for your needs, skill level, size, condition, and intended use. Product recommendations, fitting suggestions, blog content, descriptions, buying guides, customer service statements, or other information provided by The Golf Guys are for general informational purposes and are not professional, medical, safety, or performance guarantees.

You assume responsibility for the use, misuse, storage, maintenance, adjustment, and handling of products purchased from us.


12. Gift Cards, Store Credit, and Rewards

Gift cards, store credit, loyalty rewards, promotional credits, and similar balances may be subject to additional terms, restrictions, expiration rules, and exclusions. They are not redeemable for cash except where required by law.

Lost, stolen, deleted, or unauthorized gift cards or credits may not be replaced unless required by law. We reserve the right to refuse, cancel, or review gift cards, credits, or rewards suspected of fraud, abuse, error, or unauthorized use.


13. Accounts and Customer Information

You may be able to create an account or provide customer information through our website. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to provide accurate and current information and to update it as needed. We are not responsible for issues caused by inaccurate account, billing, shipping, or contact information.
